AB Taking into account the growing number of legal and de facto presumptions in European criminal proceedings in the field of organized or trifling crimes, the question arises whether its existence is compatible with the guarantees derived from the presumption of innocence. In this article we address this issue in the light of European case law and recent European legislation on these issues (Directive 2016/343/UE, on presumption of innocence), analyzing in particular under which conditions it would be reasonable to admit some of these cases of inversion of the onus probandi in our national legal systems from the point of view of fundamental rights.
