Thus, it seems crucial to have in our legal system a regulation about these transportation network platforms, so as of the occasional drivers that may participate in these applications. In the lack of an adequate regulation, agents have to adapt their behavior to the legal framework into force, adaptation that is virtually impossible –despite the unfair competition claims on the grounds of infringement of laws-, for the sector is not deregulated and the access to licenses for the exercise of the activities of taxi and car hire with a chauffeur (FHV) is blocked. After considering the legal nature of the agents that take part in these new ways of organizing transport, we perform an analysis of some of the main problems that arise in the current legal framework, proposing some de lege ferenda solutions.
