Un desafio para la Corte de Luxemburgo A1 Moraga Mejías, Miguel Ángel A2 Ediciones Universidad de Valladolid AB This article proposes that the general rule of international models about the registration and publication of the dissenting opinions be applied to the Court of Justice of the European Union.The arguments presented flow from the investigative journey that is establishing the concept of dissenting opinion, explains its existence, history, legal nature and connects it with the publicity principle as a content of the due process of law and of the democratic principle, because they are central values of the European Union. The idea of the attribution of an alleged right or competence for that the judges can to cast dissenting opinions, we the abandoned and we opt by the notion of the judge' s ability, because is more precise, otherwise the freedom of expression of the magistrates could be restricted. Although we share the utilitarianism for the applying the initial secret to the dissenting opinions in Europe, that which then flowed to the American continent where for to achieve the same effect they changed the method, we conclude that the petrifaction in the secret can not be hold ad aeternum.
