Modelo de actuación de un educador social en mediación: La custodia compartida

Abstract

El cometido de mi trabajo consiste en un recorrido sobre la mediación, centrándome en primera instancia en el origen y concepto, figura del mediador, el papel del educador social en ella, para posteriormente abordar la mediación familiar y centrarme en la custodia compartida, encontrando soluciones o alternativas para la solución de conflictos. Para la elaboración se han utilizado diversas fuentes bibliográficas, libros especializados en mediación y mediación familiar, así como fuentes legislativas. Tras haber indagado me he dado cuenta de la carencia de un modelo o intervención para la realización de este tipo de mediación, pudiendo ser un método alternativo para la resolución de conflictos y que el menor salga principal beneficiado y no quede desamparado, siendo esto lo que ha motivado la realización de este trabajo. El objetivo es dar alternativas, propuestas nuevas, donde la figura del educador/a social pueda formar parte del equipo de profesionales dentro de la mediación familiar, así se podrá mejorar la comunicación intrafamiliar, donde tenga cabida un método socioeducativo para los menores y que aunque el núcleo familiar este separado, puedan sentirse valorados, comprendidos, acogidos y formar un espacio donde apenas pueda moverse y pueda a nivel personal y emocional desarrollarse con total normalidad. A modo de conclusión, la mediación familiar es uno de los métodos más destacados en el ámbito de resolución extrajudicial de conflictos.

The assignment of my work consists of a tour on the mediation, centring on the first instance on the origin and concept, figure of the mediator, on the paper of the social educator on her, later to approach the familiar mediation and to centre on the shared custody, finding solutions or alternatives for the solution of conflicts. For the production there have been in use diverse bibliographical sources, books specialized in mediation and familiar mediation, as well as legislative sources. After investigated credit I have realized the lack of a model or intervention for the accomplishment of this type of mediation, being able to be an alternative method for the resolution of conflicts and that the minor goes out principal beneficiary and does not remain helpless, being this what has motivated the accomplishment of this work. The aim is to give alternatives, new offers, where the figure of the social education could form a part of the equipment of professionals inside the familiar, like that mediation it will be possible improve the communication intrafamiliar, where a method has fitted socioeducativo for the minors and that though the familiar this separated core, they could feel valued, understood, received and to form a space where scarcely it could move and could at the personal level and emotionally to develop with total normality. By way of conclusion, the familiar mediation is one of the methods most emphasized in the area of extrajudicial resolution of conflicts.
