La necesidad de contar con una normativa específica que limite la utilización de cláusulas abusivas por parte de las entidades financieras es una de las cuestiones que más análisis y estudios han incitado en la jurisprudencia española y también en la internacional. En este sentido, en el presente trabajo vamos a examinar una serie de características con el objetivo de identificar este tipo de cláusulas.
Por otro lado, las denominadas cláusulas suelo, pues son las que más repercusión han tenido tanto a nivel social como a nivel jurídico. The need to have specific regulations that limit the use of unfair terms by financial
institutions is one of the issues that have been most analysed and studied in
Spanish and international jurisprudence. In this sense, in this work we are going
to examine a series of characteristics in order to identify this type of clause.
On the other hand, we are going to analyse the minimum interest rate clause,
because they are the ones that have had the most repercussions both socially
and legally. For this reason, we have carried out an analysis on the jurisprudential
evolution of the effects of the nullity of these clauses, since the pronouncements
on this matter have been, at least, varied
