Aspectos de Derecho internacional privado del matrimonio entre personas del mismo sexo

Abstract

El objeto del presente trabajo es el estudio del matrimonio celebrado entre parejas del mismo sexo, desde la perspectiva del Derecho Internacional Privado. Así, a partir de un estudio del DIPr general, son estudiadas las diferentes vicisitudes que presentan las uniones matrimoniales homosexuales con elementos de extranjería, no solo de cara a su propia celebración, sino también a su reconocimiento más allá de las fronteras españolas. La ley 13/2005 supuso una extensión del régimen matrimonial a las parejas homosexuales. Si bien, reguló con eficacia la institución, la ley dejó sin abordar numerosas cuestiones de derecho internacional privado como la regulación específica del conflicto de leyes al respecto. Dichas cuestiones trataron de abordarse por la DGRN (en la actualidad Dirección General de Fe Pública y Seguridad Jurídica) en su resolución. Sin embargo, estas no han terminado de quedar resueltas.

The object of the present paperwork is the study of the same-sex marriage, from the perspective of the International Private Law. Starting from the general study of the International Private law, we will broad all the controversies present in the same-sex marriages with alien element, not only about their own celebration, but also about their recognition outside the Spanish territory. The 13/2005 act extended the legal regime of marriage to the same-sex couples. Although it effectively regulated the legal institution, the act left aside numerous issues concerning the International Private Law such as the specific regulation of the conflict of laws to this extent. These issues were intended to be broaden by the General Direction of the Registries and Notaries, although they remain at this moment unsolved.
