La teoría del Derecho natural en la obra de Juan de Mariana

Abstract

En el siguiente trabajo vamos a realizar un estudio acerca de Juan de Mariana, sus pensamientos, influencias y legado. El objetivo de este escrito es intentar entender un poco el pensamiento de este jesuita, mediante el estudio, análisis y reflexión de algunas de sus obras, y dotando a todo el contenido del iusnaturalismo que tanto caracterizó a este autor. Comenzaremos la temática abordando el contexto histórico en el que se desenvolvió el autor, es decir, su vida y obra. De esta manera podemos ver la época que le tocó vivir, y ponernos en su lugar de cara a entender mejor los escritos del padre Mariana. A continuación, daremos paso al estudio de las influencias que recibió Juan de Mariana. Para esta materia estudiaremos la configuración del Estado de Inocencia otorgada por grandes autores clásicos como Aristóteles, Santo Tomás, San Agustín, Cicerón o Marsilio de Padua. Acto seguido describiremos la configuración que da Mariana de ese Estado de Inocencia, y analizaremos el contenido fundamental de su pensamiento iusnaturalista. Esta tarea será realizada fundamentalmente mediante el análisis y reflexión de su obra “La Dignidad Real y la Educación del Rey”, aunque también utilizaré y analizaré el contenido de otras obras. Posteriormente veremos la influencia que Mariana tuvo en los pensadores políticos posteriores, sobre todo en la configuración del Estado de Naturaleza de Hobbes y Locke. Y finalizará esta obra con unas conclusiones sobre el pensamiento de Juan de Mariana y su maravilloso legado, así como con la incorporación de la oportuna bibliografía

This project is about Juan de Mariana, his thoughts, influences and legacy. The aim of this assignment is to try to understand the thinking of this Jesuit, through the study, analysis and reflection of some of his works, and providing all those contents with the natural law that characterized this author. Firstly we will begin the analysis of the topic presenting the historical context in which the author lived in. Referring to his way of live and his time, we can set ourselves in his point of view for a better approach and understanding of Padre Mariana’s writings. Secondly we will study the influences that he received from classics authors like Aristotle, Saint Thomas, Saint Augustine, Cicero and Marsilius of Padua, which contributed to the shaping of the State of Innocence. Regarding to the State of Innonce, we will describe its structure, given by Mariana, and we will analyse the elementary content of his jusnaturalist thinking. This task will be made through the analysis and reflection on his work “The Royal Dignity and Education of the King”. However, I can’t forget about some other of his works. Next, we will see the influence Mariana had over the following political thinkers, focusing on the shaping of the State of Nature of Hobbes and Locke. This Project will end up with some conclusions about Juan de Mariana’s thinking and his wonderful legacy. A bibliography will also be available at the end.
