El contrato de pignus en Roma y su régimen actual

Abstract

El contrato de prenda surge en la Antigua Roma con el objetivo de minimizar los riesgos derivados de los contratos. De tal forma que la prenda o pignus se configura como un contrato real, bilateral imperfecto, en virtud del cual una persona – el deudor pignoraticio (pignorante) – entrega a otra – el acreedor pignoraticio – una cosa en garantía de una obligación, quedando obligado el acreedor a devolverla cuando le sea satisfecho su crédito. Por lo tanto, el contrato de prenda da nacimiento a un derecho real de prenda y a un derecho de garantía. Su regulación ha ido modificándose a lo largo de la historia según el momento, hasta terminar en el contrato real de prenda que conocemos en el presente que aparece regulado en el Código Civil que no difiere en gran medida del existente en la época romana.

The pledge contract arose in Ancient Rome with the aim of minimising the risks arising from the contracts. Thus, the pledge or pignus is configured as a real, bilateral, imperfect contract, by virtue of which one person - the pledge debtor (pledgor) - gives another - the pledge creditor - a thing as security for an obligation, with the creditor being obliged to return it when his credit is satisfied. Therefore, the pledge agreement gives rise to a right in rem of pledge and a right of guarantee. Its regulation has been modified throughout history according to the moment, until ending in the real pledge contract that we know in the present that appears regulated in the Civil Code that does not differ to a great extent from the existing one in Roman times.
