El arrendamiento de vivienda para uso turístico

Abstract

En este trabajo se examina la regulación de los arrendamientos de vivienda para uso turístico a la luz de las más recientes reformas realizadas. Se inicia con el concepto de esta modalidad, distinguiéndolo de otras figuras similares (arrendamiento de vivienda, arrendamiento de temporada…), para después analizar las implicaciones que tiene en el régimen de la propiedad horizontal y como se puede limitar o prohibir tras las últimas reformas de la Ley de la Propiedad Horizontal. Se continúa con el estudio de estos arrendamientos como fenómeno de la economía colaborativa, prestando especial atención a la plataforma Airbnb y al régimen de responsabilidad de los distintos intervinientes: el arrendador, el arrendatario como de la plataforma online intermediadora. Tras esto, se descenderá a la regulación autonómica, donde se planteará en términos generales lo actuado desde las instituciones autonómicas y se realizará un análisis más pormenorizado del caso de Castilla y León. El trabajo se concluirá con unas breves conclusiones que inviten al lector a reflexionar sobre todo lo anterior.

This paper examines the regulation of short term rentals for tourism and shed some light in the recent legislative reforms. It begins with the concept, differentiating it from similar phenomena (like house rentals, seasonal rentals…), it continues analyzing the implications in the horizontal property and how limit or prohibit it after the last reforms of the “Ley de la Propiedad Horizontal”. It continues studying these rentals as a phenomenon of collaborative economy, specially focusing on Airbnb and the responsibility regimen of its intervinents: the lessor, the lessee and the online platform. After, it will be descended to autonomic regulation, where we will see, in general terms, the actuations in the autonomic institutions and, specially, in Castilla y León. This paper will be finished with a short conclusion that invites the reader to reflect on all said before.
