El Soft Law

Abstract

El Soft Law Es una herramienta relativamente moderna, que fue creada para proporcionar la ayuda necesaria al legislador al crear actos normativos. Con la globalización, la ley ha cambiado, y con su cambio ha sido necesario crear nuevas formas de producción normativa. La característica fundamental que encontramos en Soft Law es su naturaleza no vinculante, no genera obligaciones para las partes y, por lo tanto, no genera sanciones para quienes deciden no cumplir con su parte. El Soft Law se encuentra principalmente en los Tratados Internacionales, que contienen recomendaciones que los diferentes Estados se comprometen a cumplir bajo el poder de la moral y los tratados internacionales. Normalmente, Soft Law no funciona individualmente, sino que es un complemento de Hard Law, principalmente ayuda a cerrar las lagunas legales, las incertidumbres al legislar y es la forma más rápida que conocemos hasta ahora para crear leyes. En resumen, el Soft Law es la evolución de la ley que cambiará nuestras vidas y nuestras decisiones futuras.

Soft Law is a relatively modern tool, which was created to provide the necessary help to the legislator when creating normative acts. With globalization, law has changed, and with its change it has been necessary to create new forms of normative production. The fundamental characteristic that we find in Soft Law is its non binding nature, it does not generate obligations for the parties and therefore it does not generate penalties for those who decide not to fulfill their part. Soft Law is mainly found in International Treaties, which contain recommendations that the different States commit to comply with under the power of morals and thics. Normally Soft Law does not work individually, but is a complement to Hard Law, it mainly helps to close legal loopholes, uncertainties when legislating and it is the fastest way we know so far to create laws. In short, Soft Law is the irremediable evolution of law which will change our lives and our future decisions.
