Las Fuerzas y Cuerpos de Seguridad y la Violencia de Género

Abstract

La violencia de género es la forma más cruel de discriminación contra la mujer y por desgracia uno de los mayores problemas que ocupa a nuestra sociedad hoy en día. La lucha contra esta es un proceso largo, todavía pendiente de desarrollo, en el que va a ser necesaria la colaboración, por un lado, de la sociedad, y por otro lado del Estado y de las instituciones. El objetivo de este trabajo es conocer la labor realizada por las Fuerzas y Cuerpos de Seguridad contra la violencia machista, analizando en primer lugar, la normativa a la que están sometidos, la organización de los cuerpos que la componen, los principios básicos por los que se rigen en sus actuaciones y las unidades especializadas que se han creado dentro de las Fuerzas y Cuerpos de Seguridad, encargadas de la asistencia a las víctimas. A continuación, analizaremos los aspectos teóricos de la violencia de género. Es importante examinar la Ley Orgánica 1/2004 de Medidas de Protección Integral contra la Violencia de Género. En ella se contienen aspectos tan fundamentales como, por ejemplo, los derechos que amparan a las víctimas, pero en especial hay que destacar la Tutela Institucional que incluye a las Fuerzas y Cuerpos de Seguridad. Pero principalmente, nos centraremos en los Protocolos que van a seguir las Fuerzas y Cuerpos de Seguridad del Estado en colaboración y coordinación con los Órganos Judiciales y con la Policía Local. Finalmente, analizaremos el Protocolo de Valoración Policial del riesgo VPR (valoración policial del riesgo) y VPER (valoración policial de la evolución del riesgo). Se estudiará el proceso completo de la valoración policial desde que la víctima interpone la denuncia en comisaría hasta que se imponen las medidas para su protección y la importancia que puede tener una correcta valoración. Y finalmente de forma breve se analizará la adecuación de las medidas adoptadas con el fin de comprobar si con ellas se garantiza de manera total la protección, prevención y asistencia de las víctimas.

Gender violence is the cruellest form of discrimination against women and unfortunately, one of the biggest problems that occupies our society today. The fight against it is a long process still pending development, in which collaboration will be necessary, on the one hand of society, and on the other hand of the State and institutions. The objective of this work is to know the work carried out by the Security Forces and Corps against gender violence, first analyzing the regulations to which they are subjected, the organization of the bodies that compose it, the basic principles by which They will be governed in their actions and the specialized units that have been created within the Security Forces and Bodies, in charge of assisting victims. Next, we will analyze the theoretical aspects of gender violence. It is important to examine the Ley Orgánica 1/2004 de Medidas de Protección Integral contra la violencia de género. It contains such fundamental aspects as, for example, the rights that protect the victims, but in particular we must highlight the Institutional Protection that includes the Security Forces and Bodies. But mainly, we will focus on the Protocols to be followed by the State Security Forces and Bodies in collaboration and coordination with the Judicial Bodies and with the Local Police. Finally, we will analyze the Police Valuation Protocol for risk VPR (police risk assessment) and VPER (police assessment of risk evolution). The complete process of the police assessment will be studied from the moment the victim files the complaint at the police station until the measures for their protection are imposed and the importance that a correct assessment can have. And finally, in a brief way, we will examine the adequacy of the measures adopted will be analyzed in order to check whether they fully guarantee the protection, prevention and assistance of victims.
