Libertad de expresión y protección penal de los símbolos nacionales

Abstract

Este Trabajo de Fin de Grado tiene como principal objetivo, además de hacer un estudio de la evolución y de los diferentes sistemas jurídicos que lo regulan, mostrar la protección hecha por el artículo 543 del Código Penal, al delito de ultrajes, a los símbolos nacionales de España, y el choque que esta protección provoca con el ejercicio del derecho fundamental a la libertad de expresión que ostentan las personas, recogido en el artículo 20 de la Constitución. La existencia de un determinado bien jurídico protegido con este artículo, es una cuestión aún abierta en la jurisprudencia española, pues hay quienes sostienen su inexistencia y abogan por la inconstitucionalidad del precepto, y quienes mantienen la necesidad de protección que éste confiere a la Nación y a sus símbolos. A través de este trabajo, se analizan las diferentes posturas y se expone una propuesta de modificación del artículo 543 del CP, para solventar los problemas que surgen en su ámbito de sanción en relación con el derecho a la libertad de expresión.

The main objective of this Final Degree Project, in addition to studying the evolution and the different legal systems that regulate it, is to show the protection afforded by Article 543 of the Criminal Code to the crime of insulting the national symbols of Spain, and the clash that this protection causes with the exercise of the fundamental right to freedom of expression held by individuals, as set out in Article 20 of the Constitution. The existence of a specific legal right protected by this article is still an open question in Spanish jurisprudence, as there are those who maintain its non-existence and advocate the unconstitutionality of the precept, and those who maintain the need for protection that it confers on the Nation and its symbols. This study analyses the different positions and puts forward a proposal modification of Article 543 of the Criminal Code, in order to solve the problems that arise in its scope of sanction in relation to the right to freedom of expression.
