Ayudas públicas en la situación de pandemia (Covid-19)

Abstract

En el presente trabajo se analizará el concepto de ayuda pública en contexto de Covid-19 y los tipos que de la misma se desprenden en virtud de los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea. Se trata por tanto, de una ayuda permitida. Para ello, se ha analizado la situación de pandemia y los posibles inconvenientes que ha supuesto para empresas y autónomos el cierre forzoso de la actividad en sus negocios. Así como las distintas líneas de avales (préstamos ICO) que han sido ofrecidas por el Gobierno y por la Unión Europea. A tal fin, se trata de examinar si las medidas llevadas a cabo por el Ejecutivo han sido eficaces y rápidas para obstaculizar lo menos posible el crecimiento del tejido empresarial. Asimismo a través de la entrevista personal se expondrán dos casos concretos sobre como han vivido esta situación.

This paper will analyze the concept of public aid in the context of Covid-19 and the types of public aid under Articles 107 and 108 of the Treaty on the Functioning of the European Union. It is therefore a permissible aid. For this purpose, the pandemic situation has been analyzed and the possible disadvantages that the forced closure of the activity in their businesses has meant for companies and self-employed people. As well as the different lines of guarantees (ICO loans) that have been offered by the Government and the European Union. To this end, the aim is to examine whether the measures carried out by the Executive have been effective and quick to hinder as little as possible the growth of the business fabric. In addition, two specific cases of how they have experienced this situation will be presented through personal interviews.
