La colación de donaciones en la partición hereditaria

Abstract

El presente trabajo tiene por objeto hacer un análisis de los aspectos más significativos de la colación de donaciones en la partición hereditaria. La colación tiene lugar cuando a una misma sucesión concurren herederos legitimarios, habiendo recibido alguno de ellos atribuciones gratuitas del causante en vida, que salvo dispensa se considerarán recibidas a cuenta de su porción hereditaria a fin de evitar desigualdades. El estudio de esta compleja institución de derecho sucesorio presenta problemas en relación con la partición de la herencia, tanto por su conexión con otras figuras, como por la propia práctica de la colación y la forma en que se deben valorar los bienes sujetos a ella. Por lo tanto, partimos del estudio del derecho positivo, para relacionarlo con el conocimiento de la jurisprudencia del Tribunal Supremo.

The aim of this work is to make an analysis of the most significant aspects of the collation of donations in the hereditary partition. The collation takes place when legitimate heirs concur to the same succession, having received some of them free attributions from the deceased while he is alive, which, unless exempted, will be considered received on account of his hereditary portion, in order to avoid inequalities. The study of this complex institution of inheritance law presents problems in relation to the partition of inheritance, because of its connection with other figures, as well as the practice of collation and the way in which the subject assets should be valued. Therefore, we start from the study of positive law, to relate it to the knowledge of the jurisprudence of theSupreme Court.
