El expediente de dominio tras la Ley de jurisdicción voluntaria de 2015

Abstract

El expediente de dominio fue regulado por primera vez en la Ley Hipotecaria de 1869, y poco a poco su régimen jurídico ha ido ampliándose hasta la Ley Hipotecaria de 1946. Cuando su regulación sufrió más cambios fue en el año 2015, mediante una reforma que transformó un expediente judicial en un expediente notarial. Este procedimiento es muy relevante en el ordenamiento jurídico español, ya que gracias al mismo pueden tener acceso a nuestro sistema registral fincas que nunca han accedido al mismo u obtener su reanudación en el tracto registral.

The domain record was regulated for the first time in the Mortgage Law of 1869, and little by little its legal framework was been increasing until the Mortgage Law of 1946. When its regulation underwent more changes was in year 2015, through a reform that transformed a judicial record into a notary record. This procedure is very relevant in the Spanish legal system, because thanks to it, properties that have never accessed to our registry system can have that access or can obtain its reinstatement in the registry chain.
