El fideicomiso en Roma y en el Derecho civil moderno

Abstract

En el siguiente trabajo se expondrán los orígenes de la institución del Fideicomiso en el Derecho Romano. Así mismo, se aludirá a un estudio en profundidad de su uso por los diferentes tipos de sujetos así como su finalidad y clasificación. Son también ámbito de estudio las vicisitudes que el fideicomiso guarda con figuras análogas como por ejemplo la fiducia o el legado. Llegando hasta nuestros días se hará un especial análisis del articulado del Código Civil, con protagonismo de la institución de la sustitución fideicomisaria. Tras un breve estudio de derecho comparado, se acabará por realizar un estudio comparativo del pasado y presente del fideicomiso.

The following work will expose the origins of the institution of the Trust in Roman Law. In order to do this, an in-depth study of its use by different types of subjects as well as its purpose and classification will be alluded to. The vicissitudes that the trust has with similar figures such as trust or legacy are also an area of study. Coming to this day, a special analysis will be made of the articles of the Civil Code, with a leading role in the institution of trustee replacement. After a brief study of comparative law, a comparative study of the past and present of the trust will explained.
