El humanismo jurídico francés y suiInfluencia en la historia del derecho europeo

Abstract

El objetivo del presente trabajo consiste en exponer qué aportaciones e influencia tuvo la corriente intelectual del Humanismo jurídico francés. Analizaremos por tanto, las que consideramos, las cuatro ideas que han sido una influencia imprescindible para la obtención del concepto de Derecho actual y, por ende, de la influencia que las mismas han tenido en la historia del derecho. Para llegar a estas aportaciones, se expondrá también los motivos que sustentan el movimiento y su origen en el siglo XIV hasta el siglo XVI , donde acaba desarrollándose en Francia gracias a su fundador el jurista Andrea Alciato. La metodología que crea, influye a otros juristas que a su vez aportaron nuevas ideas que otorgaron la singularidad que posee al que ahora denominamos humanismo jurídico francés.

The aim of this study is to explain the contributions and influence of the intellectual current of French legal humanism. We will therefore analyse what we consider to be the four ideas that have been an essential influence in obtaining the current concept of Law and, therefore, the influence that they have had on the history of law. In order to arrive at these contributions, we will also explain the reasons behind the movement and its origin in the fourteenth century until the sixteenth century, where it finally developed in France thanks to its founder, the jurist Andrea Alciato. The methodology he created influenced other jurists who in turn contributed new ideas that gave the singularity to what we now call French legal humanism.
