La desheredación

Abstract

Dentro de nuestro ordenamiento jurídico, el Derecho de Sucesiones es la parte del derecho privado que se encarga de regular las relaciones jurídicas de la persona que fallece. Dentro de esta parte del derecho, cabe destacar la figura de la desheredación, institución por la cual se priva a un heredero forzoso de los derechos legitimarios que le corresponden. En el presente trabajo, se analizará cada detalle de la regulación de la figura, no solo en el Derecho Común, sino también en el Derecho Foral con el objetivo de comprender las nuevas interpretaciones que están dando los tribunales acerca de la figura

In our legal system, inheritance law is the part of private law that is responsible for regulating the legal relations of the person who dies. Within this part of the law, it is worth highlighting the figure of disinheritance, an institution by which a forced heir is deprived of the legitimate rights to which he or she is entitled. In this study, we will analyse every detail of the regulation of the figure, not only in Common Law, but also in Foral Law, with the aim of understanding the new interpretations that the courts are giving to the figure.
