Conflicto entre costumbre y derechos humanos. Las vírgenes juradas en Albania.

Abstract

A finales del siglo XV apareció en Albania “el Kanun”, un código consuetudinario cuyo fin era establecer un orden en la sociedad del momento, conteniendo en él las costumbres propias de las comunidades que habitaban en la zona de los Balcanes. Una de las prácticas que en la actualidad sigue existiendo es la de las vírgenes juradas, mujeres que juraban su castidad de por vida para garantizar la protección de su familia en caso de la falta de una figura masculina o para evitar un matrimonio pactado. El análisis realizado de esta práctica en la actualidad conduce a la conclusión de que vulnera varios de los derechos humanos recogidos en la Declaración de 1948 y otros textos internacionales, así como la propia Constitución Albanesa. En la paulatina desaparición de esta práctica están interviniendo diversos factores entre los que destaca la globalización, que ha traído consigo los movimientos feministas con las profundas consecuencias que suponen en la sociedad actual.

At the end of the 15th century "the Kanun" appeared in Albania, a customary code whose purpose was to establish order in the society of the time, containing in it the customs of the communities that inhabited the Balkan area. One of the practices that still exists today is that of the sworn virgins, women who swore their chastity for life to ensure the protection of their family in case of the lack of a male figure or to avoid an arranged marriage. The analysis of this practice today leads to the conclusion that it violates several of the human rights enshrined in the 1948 Declaration and other international texts, as well as the Albanian Constitution itself. In the gradual disappearance of this practice are intervening various factors among which globalization, which has brought with it the feminist movements with the profound consequences that they imply in today's society.
