La protección del interés del menor en casos de crisis matrimonial

Abstract

El presente trabajo analiza el interés superior del menor como interés preferente, su regulación actual y su interpretación por la jurisprudencia española, además de estudiar su aplicación como principio rector en los supuestos de ruptura matrimonial, siendo los hijos el eje central del procedimiento de nulidad, separación o divorcio en la regulación española y su protección una de las obligaciones de nuestros jueces y tribunales en último término.

The present paper analyzes the best interest of the minor as a preferred interest, its current regulation and its interpretation by the Spanish jurisprudence, plus studying the application of this principle as leader in marital breakdown cases, in response of children being the main characters in divorce or separation procedures in Spanish law, because their protection stands as one of the duties of our judges and courts in last term.
