Naturaleza de los bienes privativos y gananciales: análisis jurisprudencial

Abstract

El siguiente trabajo tiene el objetivo de analizar tanto doctrinal, como jurisprudencialmente a través de resoluciones de diferentes Tribunales, la naturaleza privativa o ganancial de los bienes, observando algunos supuestos en los que se produce un cambio en la postura del Tribunal Supremo sobre la atribución del carácter ganancial de los bienes, o bien considerándolos privativos de uno de los cónyuges. Analizaremos los artículos del Código Civil acerca del carácter privativo o ganancial de los bienes, centrándonos detenidamente en la clasificación que recogen los artículos 1346 y 1347 del Código, dando lugar en algunos supuestos a conclusiones dispares.

The following work has the objective of analyzing both doctrinally and jurisprudentially through resolutions of different Courts, the privative or ganancial nature of the goods, observing cases in which there is a change in the position of the Supreme Court on the attribution of the ganancial character of the goods, or considering them privative of one of the spouses. We will analyze the articles of the Civil Code on the privative or community property nature of the assets, focusing closely on the classification contained in articles 1346 and 1347 of the Code, giving rise in some cases to different conclusions.
