Derecho y poder en Carl Schmitt

Abstract

Es un hecho innegable que Carl Schmitt, pese a las ofensas que pueda causar, pertenece a las filas de los teóricos políticos y jurídicos más influyentes de la Europa de entreguerras del siglo XX. Su experiencia en una época tan convulsa, donde el Derecho era incapaz de desligarse de la política y la filosofía, arroja una serie de obras de una extraordinaria calidad técnica. El contenido de estas obras, para bien o para mal, reflejan el modo de pensar acorde al auge de los totalitarismos de este periodo y nos abre la puerta a entender, de una manera alternativa, los fenómenos del Derecho y la política. Los esfuerzos más destacados de Carl Schmitt se dirigieron mayormente a proporcionar respuestas a los desafíos de la inestabilidad e indeterminación legal y, especialmente, a la construcción de un orden legal nazi posliberal. Pero su pensamiento no ha quedado anclado a esa época, tras un tiempo de letargo, las tesis de Schmitt han vuelto a tomar protagonismo con el auge de la extrema derecha, así como con los ataques terroristas de principios del siglo XXI y la reciente pandemia de COVID-19, situaciones a los que los gobiernos liberales han respondido con una andanada de medidas de emergencia y en los que Carl Schmitt era avezado. Esto no hace sino aumentar la importancia, y por ende el interés, de aquel que busque ser más conocedor del siglo pasado, así como de sus vicisitudes y aprensiones, que indudablemente nos han llevado al actual tiempo en el que vivimos.

It is an undeniable fact that Carl Schmitt, despite the offence he may cause, belongs to the ranks of the most influential political and legal theorists of inter-war Europe in the 20th century. His experience in such a turbulent period, when law was unable to separate itself from politics and philosophy, has produced a series of works of extraordinary technical quality. The content of these works, for better or for worse, reflects the way of thinking in accordance with the rise of the totalitarianisms of this period, and opens the door to an alternative understanding of the phenomena of law and politics. Carl Schmitt's most prominent efforts were largely directed towards providing answers to the challenges of legal instability and indeterminacy, and especially to the construction of a post-liberal Nazi legal order. But his thinking has not remained anchored to that time, after a period of lethargy, Schmitt's theses have once again taken center stage with the rise of the extreme right-wing parties, as well as with the terrorist attacks of the early 21st century and the recent COVID-19 pandemic, situations to which liberal governments have responded with a barrage of emergency measures, in which Carl Schmitt was an expert. This only increases the importance, and therefore the interest, of anyone seeking to become more knowledgeable about the past century, as well as its vicissitudes and apprehensions, which have undoubtedly led us to the current time in which we live.
