Abstract

La disparidad de legislaciones entorno al régimen jurídico de las personas menores de edad en situación de conflicto con la ley ha provocado el establecimiento por la Organización de Naciones Unidas de una serie de normas y directrices que sirvan como parámetros mínimos para que los Estados creen y apliquen un sistema de justicia especializado que garantice los derechos de los menores de edad evolucionando hacia el sistema de justicia restaurativa, a través de las Reglas mínimas para la Administración de justicia de menores, la Convención sobre los Derechos del Niño, Reglas mínimas sobre medidas no privativas de libertad, las Directrices para la prevención de la delincuencia juvenil y las Reglas para la protección de menores privados de libertad. Estos parámetros se complementan con las Observaciones Generales del Comité de los Derechos del Niño y demás instrumentos relativos a la materia, en los que han influido notablemente los Congresos de Naciones Unidas sobre Prevención del Delito y Tratamiento del Delincuente.

The disparity of legislation regarding the legal regime for minors in conflict with the law has led to the establishment by the United Nations of a series of standards and guidelines that serve as minimum parameters for States to create and apply a specialised justice system that guarantees the rights of minors, evolving towards a system of restorative justice, through the United Nations Standard Minimum Rules for the Administration of Juvenile Justice, the Convention on the Rights of the Child, the United Nations Standard Minimum Rules for Non-custodial Measures, the United Nations Guidelines for the Prevention of Juvenile Delinquency and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty. These parameters are complemented by the General Comments of the Committee on the Rights of the Child and other relevant instruments, which have been strongly influenced by the UN Congresses on the Prevention of Crime and the Treatment of Offenders.
