Oliver Wendell Holmes: Contribución al realismo jurídico

Abstract

La figura del jurista Oliver Wendell Holmes se sitúa en un momento crítico para el desarrollo del pensamiento jurídico norteamericano. A lo largo del trabajo analizaremos como esta figura representa un punto de inflexión en el sistema jurídico y como hace grandes aportaciones para la difusión de ideas e información, modernizando la jurisprudencia. De esta forma, inicio desarrollando los primeros años de O.W.Holmes, ubicándolo en un contexto social y analizando sus grandes aportaciones para una mejor compresión. Desarrollo las diferentes filosofías de nuestro autor y cómo defiende las ideas orientadas a la libertad de expresión, lo que le hizo ser tachado de ‘gran disidente’ por sus votos particulares. De entre todas estas ideas, nos detendremos de forma más detallada en el realismo jurídico; así como las nociones principales de tal corriente y la contribución de O.W.Holmes. Por último, analizo su obra ‘The Path of the Law’, en la que nos ofrece una visión de métodos jurídicos, creencias y valores para el avance de la jurisprudencia.

The figure of the jurist Oliver Wendell Holmes is situated at a critical moment in the development of American legal thought. Throughout this paper we will analyse how this figure represents a turning point in the legal system and how he makes great contributions to the dissemination of ideas and information, modernising jurisprudence. In this way, I begin by developing the early years of O.W. Holmes, placing him in a social context and analysing his great contributions for a better understanding. Throughout the work I analyse the different philosophies of our author and how he defends ideas oriented towards freedom of expression, which led him to be branded as a 'great dissenter' by his private votes. Among all these ideas, we will dwell in more detail on legal realism; as well as the main notions of such a current and the contribution of O.W. Holmes. Finally, I analyse his work 'The Path of the Law', in which he offers us a vision of legal methods, beliefs and values for the advancement of jurisprudence.
