El Derecho de Gentes en John Rawls

Abstract

Ahora más que nunca, ante el creciente aumento de las tensiones y conflictos internacionales, se hace necesario volver la vista a los grandes pensadores que, como John Rawls, aportaron análisis, conocimiento y esperanza para tratar de evitarlos. Resulta lógico preguntarse entonces qué nuevo artículo o libro escribiría Rawls ante las circunstancias mundiales actuales y, sobre todo, ante la guerra de Rusia y Ucrania, pero como esto ya no es posible, solo se puede acudir a su pensamiento a través de sus obras, examinar sus aportaciones sobre cómo establecer una alianza pacífica y duradera de los pueblos, de su Derecho de Gentes, y profundizar en su visión sobre el problema de la guerra por si pudiera aportar algo de luz a esta catástrofe en las relaciones y en el propio derecho internacional que parece haber socavado toda la teoría e instrumentos internacionales alcanzados tras el último gran conflicto mundial. Y, como Rawls, desde la humildad y con la esperanza de que la reflexión sirva para alcanzar un orden mundial más justo

Now more than ever, in the face of rising international tensions and conflicts, it is necessary to look back to the great thinkers who, like John Rawls, provided analysis, knowledge and hope to try to avoid them. It is logical to wonder what new article or book Rawls would write in the face of current world circumstances and, above all, in the face of the war in Russia and Ukraine, but as this is no longer possible, one can only turn to his thought through his works, examine his contributions on how to establish a peaceful and lasting alliance of peoples through his Law of Peoples and delve into his views on the problem of war in case he could shed some light on this catastrophe in international relations and international law itself that seems to have undermined all the international theory and instruments reached after the last great world conflict. And, like Rawls, with humility and in the hope that the reflection will serve to achieve a more just world order.
