La acción popular

Abstract

En el presente trabajo vamos a abordar el estudio y análisis de la acción popular en el proceso penal, una figura controvertida de nuestro Ordenamiento Jurídico. El significado de la acción popular se centra en que cualquier sujeto puede incoar un proceso penal sin ser el afectado directo por el delito. Es garante del derecho a la tutela judicial efectiva, cuyo principal objetivo es fomentar en la Administración de Justicia las características de la democracia. No obstante, aunque la acción popular dista mucho de la acusación particular, veremos que el límite entre ambas figuras se encuentra difuso a falta de una regulación más afianzada. Su objeto de debate no solo se centra en su reconocimiento constitucional, más concretamente en los artículos 24 y 125 de la Constitución Española, sino también en las personas que se encuentran legitimadas para ejercitarla. Se analizarán los límites jurisprudenciales de esta figura y por último la necesidad urgente de reforma.

In this paper we are going to study and analyse the popular action in criminal proceedings, a controversial figure in our legal system. The meaning of the popular action is centred on the fact that any subject can initiate criminal proceedings without being directly affected by the crime. It is the guarantor of the right to effective judicial protection, the main aim of which is to promote the characteristics of democracy in the administration of justice. However, although the popular action is a far cry from the private prosecution, we will see that the boundary between the two is blurred in the absence of a more established regulation. The subject of debate focuses not only on its constitutional recognition, more specifically in Articles 24 and 125 of the Spanish Constitution, but also on the persons entitled to bring it. The jurisprudential limits of this figure will be analysed and, finally, the urgent need for reform.
