Mandato preventivo

Abstract

El presente trabajo sobre “El mandato preventivo” analiza la posibilidad de la persona, física o jurídica, que, en su propia autonomía, tenga la capacidad de decidir acerca del futuro de sus intereses económicos y personales, designando a otra persona, el mandatario, para que le represente legalmente en determinados actos jurídicos en caso de sufrir un hecho incapacitante. El mandato preventivo fue introducido mediante la Ley 41/2003, de 18 de noviembre, sobre protección patrimonial de las personas con discapacidad y de modificación del Código Civil, de la Ley de Enjuiciamiento Civil y de la Normativa Tributaria con esta finalidad, mediante la reforma del artículo 1732 del Código Civil, y actualmente regulado por la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo de las personas con discapacidad en el ejercicio de su capacidad jurídica

The present essay on "The preventive mandate" analyses the possibility of the person, natural or legal, who, in their own autonomy, has the capacity to decide about the future of their economic and personal interests, designating another person, the mandatary, to legally represent them in certain legal acts in the event of suffering an incapacitating event. The preventive mandate was introduced by Law 41/2003, of 18 November, on the patrimonial protection of people with disabilities and the modification of the Civil Code, the Civil Procedure Act and the Tax Regulations for this purpose, through the reform of article 1732 of the Civil Code, and currently regulated by Law 8/2021, of June 2, which reforms civil and procedural legislation to support people with disabilities in the exercise of their legal capacity
