La legítima defensa

Abstract

El presente trabajo llevará a cabo un análisis de la legítima defensa, eximente de la responsabilidad penal reconocida en el artículo 20.4 del Código Penal. Para ello, se descompondrá la mencionada eximente en cada una de las características que la componen, para poder ser analizadas detalladamente. El trabajo comenzará con la fundamentación, naturaleza jurídica y evolución histórica de la legítima defensa, seguido de los bienes jurídicamente protegidos y los presupuestos objetivos y subjetivos, para finalizar con los supuestos que permiten observar la eximente completa e incompleta. Todo ello con el apoyo de la jurisprudencia del Tribunal Supremo

This final degree project will carry out an analysis of self-defense, a legal defense recognized in article 20.4 of the Penal Code. For it, the mentioned defense will be broken down into each of its constituent elements in order to be thoroughly analyzed. The final degree Project will begin with the fundament, legal nature and historical evolution of self-defense, followed by the legally protected interests and the objective and subjective requirements. It will conclude with the scenarios that allow for the observation of complete and incomplete self-defense, all supported by the jurisprudence of the Supreme Court.
