La Corte Penal Internacional: evolución, competencia y funcionamiento

Abstract

El presente Trabajo de Fin de Grado tiene por objeto el estudio del ejercicio de la justicia en el ámbito penal a nivel internacional. Para ello, se ha partido de la rama del Derecho Penal Internacional y de su evolución, sobre todo tras la Segunda Guerra Mundial, para conocer su culminación en la actualidad con la creación de la Corte Penal Internacional, principal Tribunal internacional encargado de impartir justicia penal por la comisión de los mayores crímenes internacionales. Se ha estudiado la conexión del Derecho Penal Internacional con otros órganos jurisdiccionales surgidos a lo largo del Siglo XX, Tribunales militares y Tribunales ad hoc, creados tras conflictos internacionales, los cuales han perseguido la impartición de justicia tras sucesos históricos concretos. Por último, se ha analizado la Corte Penal Internacional, desde su composición, hasta los crímenes objeto de su competencia, pasando por explicar, brevemente, el proceso que regula el Estatuto de Roma y las Reglas de Procedimiento y Prueba.

The purpose of this Final Degree Project is to analyze the way penal justice is executed at international level. To reach this aim, the first step has been to study International Criminal Law and its development, mainly after World War II, to know the main steps taken to create the International Criminal Court, the one in charge of giving penal justice when the worst international crimes are committed. The conexion between International Criminal Law and other jurisdictional institutions which appeared along the twentieth century, such as Military Courts and ad hoc Tribunales has been studied as the result of the appearance of these Tribunals after international conflicts to pursue the crimes comitted in them. Lastly, this project has analyzed the composition of the International Criminal Court, the crimes it juzges, the process ruled by the Rome Statute and the 225 Rules of Procedure and Evidence.
