El tercer grado penitenciario. La reinserción en el sistema español

Abstract

El presente Trabajo de Fin de Grado (TFG) tiene como objetivo analizar el sistema penitenciario español y, dentro de éste, el tercer grado penitenciario y su relación con la reinserción social en el contexto español. El tercer grado, también conocido como régimen abierto, puede definirse como una fase de ejecución de la pena cuya principal característica es la adopción de medidas de flexibilización en el cumplimiento de la pena; y en este sentido está orientado a favorecer la reintegración de las personas que han cumplido penas privativas de libertad en la sociedad. En primer lugar, se examina el marco legal y normativo que regula el tercer grado en España, destacando la Ley Orgánica General Penitenciaria (LOGP) y el Reglamento Penitenciario (RP). Se estudian los requisitos y criterios que se deben cumplir para acceder al tercer grado, así como las características y los mecanismos de control propios de este régimen. Se analiza la relación entre el tercer grado penitenciario y la reinserción social. Se examinan las medidas y programas de rehabilitación y reinserción implementados en los centros penitenciarios españoles, enfocados a la formación, la capacitación laboral, la atención psicosocial y el apoyo familiar. Asimismo, se trata de ver la influencia que en la práctica tienen estos programas en la prevención de la reincidencia delictiva Se abordan también los desafíos y obstáculos a los que en la actualidad se enfrenta el régimen abierto y estos programas de reinserción. Se analizan cuestiones como la estigmatización social, la falta de recursos y apoyo externo, la necesidad de una coordinación interinstitucional efectiva y el riesgo de reincidencia. El presente trabajo supone un acercamiento al tercer grado penitenciario y su comprensión, así como al fin constitucional de reinserción social.

The aim of this Final Degree Project (TFG) is to analyze the Spanish penitentiary system and, within it, the third penitentiary degree and its relationship with social reintegration in the Spanish context. The third degree, also known as the open regime, can be defined as a phase of execution of the sentence whose main characteristic is the adoption of measures of flexibility in the fulfillment of the sentence; and in this sense, it is aimed at favoring the reintegration of people who have served custodial sentences into society. Firstly, the legal and regulatory framework that regulates the third degree in Spain is examined, highlighting the General Penitentiary Organic Law (LOGP) and the Penitentiary Regulations (RP). The requirements and criteria that must be met to access the third degree are studied, as well as the characteristics and control mechanisms of this regime. The relationship between the third degree of prison and social reintegration is analyzed. Rehabilitation and reinsertion measures and programs implemented in Spanish prisons are examined, focused on training, job training, psychosocial care and family support. Likewise, it is about seeing the influence that these programs have in practice in the prevention of criminal recidivism. The challenges and obstacles currently faced by the open regime and these reinsertion programs are also addressed. Issues such as social stigmatization, lack of resources and external support, the need for effective inter-institutional coordination and the risk of recidivism are analyzed. The present work supposes an approach to the third penitentiary degree and its understanding, as well as to the constitutional aim of social reintegration.
