La transmisión de la propiedad en el Derecho Romano

Abstract

En este trabajo tratamos la regulación de la transmisión de la propiedad en el Derecho Romano, distinguiendo la época clásica de la época del derecho justinianeo. Destacamos como el corpus iuris civilis recoge el principio de transmisión del título y el modo. Después estudiamos el derecho histórico intermedio hasta la codificación y, finalmente, presentamos los distintos sistemas de transmisión de la propiedad en el derecho moderno, deteniéndonos en la regulación del derecho español (Código Civil, Ley Hipotecaria).

In this paper we deal with the problem of transfer of ownership in Roman Law distinguishing the classical period and the Law of Justinian. We stress that the Corpus Iuris Civilis stablishes the rule of transfer by titulus and modus. Then we study the history of law since the late Antiquity until the modern codification of private law and finally, we present the diferent sistems of transfer of ownership in modern law with special atention to Spanish civil law.
