Los derechos fundamentales en el sistema penitenciario: el Régimen F.I.E.S

Abstract

A lo largo de la historia el sistema penitenciario español ha sufrido un cambio de dirección y concepto, paralelo a la evolución de la sociedad española. El hecho más importante que desencadenó este cambio fue la aprobación de la Constitución Española de 1978, la cual ha supuesto cambios profundos en la legislación penal, en el trato a los presos y las condiciones de las prisiones. El objetivo del sistema penitenciario español es asegurar y coordinar el cumplimiento de las penas y la custodia con la rehabilitación social de los internos. La cuestión principal de este trabajo será analizar los derechos fundamentales en el sistema penitenciario español y el desarrollo del régimen FIES como instrumento de control de la Administración penitenciaria.

Throughout history the Spanish prison system has undergone a change of direction an concept, parallel to the evolution of Spanish society. The most important event that triggered this change was the adoption of the Spanish Constitution of 1978, which has brought about profound changes in criminal legislation, the treatment of prisoners and prison conditions. The aim of the Spanish prison system is to ensure and coordinate the enforcement of sentences and custody with the social rehabilitation of inmates. The main focus of this paper will be to analyse fundamental rights in the Spanish prison system and the development of the FIES regime as an instrument of control by the prison administration.
