El matrimonio romano. Características y evolución

Abstract

El matrimonio es una de las instituciones fundamentales de la sociedad romana y siempre ha existido. Es a partir de la época clásica cuando se perfila la regulación de los distintos aspectos que lo conforman, siendo influido por la concepción social y moral de aquellos tiempos. El objetivo de este trabajo es exponer de manera minuciosa y clara las diversas cuestiones necesarias para que un matrimonio pueda calificarse como legítimo, cómo el estudio de las distintas situaciones sociales que pueden influir en el matrimonio, tomando como referencia la interpretación de la multitud de textos de juristas que se han dedicado a tratar de plasmar en sus escritos aspectos del matrimonio romano. Empezaremos mencionando los actos preparatorios del matrimonio romano, los esponsales, y, posteriormente, nos adentraremos en el concepto y su desarrollo, haciendo referencia a situaciones ajenas al matrimonio, pero con una gran repercusión en él. Para terminar, valoraremos las transformaciones más relevantes que ha sufrido la institución matrimonial a lo largo del tiempo, en concreto, en la época postclásica.

Marriage is one of the fundamental institutions of Roman society and has always existed. It is from the classical period onwards that the regulation of the different aspects that make it up have been outlined, being influenced by the social and moral conception of those times. The aim of this work is to set out in a detailed and clear way the different issues necessary to qualify as a marriage legitimate, and the analysis of the different social situations that can influence marriage, taking as a reference the interpretation of the multitude of texts by jurists who dedicated their whole lives to try to capture different aspects of Roman marriage in their writings. We will begin by mentioning the preparatory acts of Roman marriage, the sponsalia and then we will go into the concept and its development, making reference to situations outside marriage, but with a great repercussions in it. Finally, we will assess the most relevant transformations that the institution of marriage has undergone over time, specifically during the post-classical period.
