La novedosa reforma en materia de discapacidad generada por la Ley 8/2021, de 2 de junio pretende ajustar nuestro ordenamiento jurídico español a la Convención Internacional sobre los Derechos de las Personas con Discapacidad de 2006. Dicha adaptación normativa ha provocado una verdadera revolución en la interpretación y en el tratamiento de la discapacidad, dejando atrás el conocido modelo de sustitución en la toma de decisiones por un novedoso sistema respaldado por las medidas de apoyo, donde el respeto a la voluntad, deseos y preferencias de las personas con discapacidad se eleva como el planteamiento fundamental de la nueva reforma. Por todo ello, el presente trabajo tiene como objetivo el estudio y análisis de la Ley 8/2021, tratando los principales avances introducidos en el Código Civil.
The new reform on disability genered by Law 8/2021, of June 2, aims to adjust our Spanish legal system to the Internacional Convention on the Right of Persons with Disabilities of 2006. This regulatory adaptation has caused a true revolution in the interpretation and treatment of disability, leaving behind the well-known model of substitution in decisión-making for a new system backed by support measures, where respect for the will, whises and preferences of people with disabilities is the fundamental approach of the new reform. Therefore, the purpose of this paper is the study and analysis of Law 8/2021, dealing with the main advances introduced in the Civil Code.
