Efectos de las normas jurídicas según Francisco Suárez

Abstract

Este artículo destaca el papel de Francisco Suárez como uno de los más grandes teólogos y juristas de la Escuela española de derecho natural. Suárez hizo una importante contribución a la teoría de las normas jurídicas al desarrollar los efectos de las leyes: mandato, prohibición, permisión y castigo. En concreto, respecto de las normas permisivas, la idea de que toda ley produce obligación requiere que una regla permisiva también esté amparada por otra norma imperativa. Su concepción de la ley la dota de una estructura prescriptiva que acentúa los aspectos voluntaristas; sin embargo, está perfectamente integrada con la pretensión de justicia objetiva y con la justicia formal imprescindibles para la validez cualquier acto legislativo. ABSTRACT: This article contributes to highlight the role of Suarez as one of the greatest theologians and jurists of the Second Scholastic (early modern scholasticism), or also called Spanish School of Natural Law. Suarez made an important contribution to the theory of the Legal System. It develops the effects of law, considering the legal order as a whole: the force of law is to command, forbid, permit, punish. In particular, with respect to permissive norms, the idea of all law imposed obligation requires that a permissive rule is also covered by another mandatory rule that mandates compliance. This conception of the law in Suarez endows it with a prescriptive structure that accentuates the voluntarist aspects, however it is perfectly integrated with the claim of objective justice and with the formal justice that are necessary in any act of legislating.
