El Derecho de usufructo. Los usufructos especiales

Abstract

En este trabajo se va a abordar la explicación del usufructo, así como de los usufructos especiales dentro de la categoría de usufructo encontramos una categoría particular, los usufructos especiales consisten en el derecho de usar y disfrutar de los bienes de otra persona, con la obligación de conservar su forma y sustancia estos usufructos especiales se refieren a situaciones específicas, y tienen unas normas particulares en relación con el usufructo en general. En la legislación española, el usufructo se regula en los artículos 467 a 522 del Código Civil, sus características dependen del objeto que trate el usufructo. Estas figuras de usufructos especiales fueron creadas para dar cabida a unas determinadas situaciones particulares, en las que el usufructo consiste en bienes que necesitan una regulación específica dentro del usufructo en general, ya que el usufructo puede recaer sobre cosas que se separan del modelo habitual, y tengan unas consecuencias jurídicas diferentes. Debido a la particularidad de estos usufructos especiales, ya sea por sus tipos o por las características, nos debemos preguntar si es útil para la realidad actual. Para ello analizamos los diferentes aspectos que giran en torno a la figura del usufructo, y concretamente a las categorías de los usufructos especiales, comprobando si estos se aplican en la actualidad y si son útiles, con ayuda de la jurisprudencia.

In this work we will address the explanation of usufruct, as well as special usufructs, within the category of usufruct we find a particular category, special usufructs, these consist of the right to use and enjoy the property of another person, with the obligation to preserve its form and substance, these special usufructs refer to specific situations, and have particular rules in relation to usufruct in general. In Spanish legislation, usufruct is regulated in articles 467 to 522 of the Civil Code, its characteristics depend on the object that the usufruct deals with. These figures of special usufruct were created to accommodate certain particular situations, in which the usufruct consists of goods that need specific regulation within the usufruct in general, since the usufruct can fall on things that are separated from the usual model, and have different legal consequences. Due to the particularity of these special usufructs, whether due to their types or characteristics, we must ask ourselves if it is useful for the current reality. To do this, we analyze the different aspects that revolve around the figure of usufruct, and specifically the categories of special usufructs, checking if these are currently applied and if they are useful, with the help of jurisprudence.
