El artículo 3 del Protocolo 4 al Convenio Europeo de Derechos Humanos en relación con la expulsión y la denegación de entrada en el territorio nacional a los propios nacionales

Abstract

El artículo 3 del Protocolo N. º4 al Convenio Europeo de Derechos Humanos garantiza dos derechos: el derecho a no ser expulsado y el derecho a entrar libremente en el territorio del Estado del cual se es nacional. Es importante diferenciar entre el artículo 3, que prohíbe la expulsión de los nacionales y el artículo 4, que prohíbe las expulsiones colectivas de extranjeros. La finalidad del presente trabajo es analizar el ámbito de protección de este derecho, explorar las razones históricas y jurídicas de su aparición, el papel del Tribunal Europeo de Derechos Humanos en su interpretación y aplicación, y el impacto de su jurisprudencia en la legislación y políticas nacionales, con un enfoque particular en el asunto H.F y otros contra Francia. Además, pondré en contraste los desafíos y dilemas en la aplicación de estos derechos en contextos de seguridad nacional y lucha contra el terrorismo.

Article 3, Protocol No. 4 guarantees two different rights: the right not to be expelled from and the right to enter the territory of the State of which one is a national. It is important to distinguish between Article 3, which prohibits the expulsion of nationals, and Article 4, which prohibits collective expulsions of aliens. The purpose of this paper is to analyze the scope of protection of this right, to explore the historical and legal reasons of its origins, the role of the European Court of Human Rights in its interpretation and application, and the impact of its jurisprudence on national legislation and policies, specially focusing on the case of H.F. and others v. France. Additionally, I will contrast the challenges and dilemmas in the application of these rights in contexts of national security and the fight against terrorism.
