El derecho a la asistencia jurídica gratuita

Abstract

El derecho a la asistencia jurídica gratuita es una prerrogativa garantizada en la Constitución Española, desarrollado por la Ley 1/1996, de 10 de enero de 1998 y en el Real Decreto 141/ 2021, de 9 de marzo, por el que se aprueba el Reglamento de la asistencia jurídica gratuita. Este derecho tiene como objeto asegurar el acceso universal a la justicia de forma gratuita para aquellas personas carentes de suficientes recursos económicos. La mencionada Ley contempla en su contenido una serie de requisitos y un procedimiento para realizar la solicitud, entre otros elementos. En el transcurso de este trabajo se analizará este derecho, su ámbito subjetivo, los requisitos a cumplir, el contenido, el procedimiento a llevar a cabo, junto con la definición del concepto de asistencia jurídica gratuita, su fundamento y marco constitucional.

The right to free legal assistance is a prerogative guaranteed in the Spanish Constitution, developed by Law 1/1996, of January 10, 1998 and in Royal Decree 141/2021, of March 9, which approves the Regulation of free legal aid. This right aims to ensure universal access to justice free of charge for those people without sufficient economic resources. The aforementioned Law contemplates in its content a series of requirements and a procedure to make the request, among other elements. In the course of this work, this right will be analyzed, its subjective scope, the requirements to be met, the content, the procedure to be carried out, along with the definition of the concept of free legal assistance, its foundation and constitutional framework.
