El legado de prestaciones periódicas

Abstract

El artículo 880 del Código Civil expone el legado de prestaciones periódicas como una de las posibilidades jurídicas de las que dispone el causante a incluir en su testamento. Es un legado de tracto sucesivo en virtud del cual el legatario adquiere un derecho de crédito, al ser legada una pensión periódica o cierta cantidad anual, mensual o semanal a un legatario, el cual podrá exigir la del primer período, desde el momento de la muerte del testador, y la de los siguientes al inicio de cada uno de ellos, sin que pueda devolverse la pensión o cantidad si el legatario fallece antes de que termine el período en curso. Si bien, ante el posible incumplimiento del gravado con el legado de su obligación de entrega del legado, el ordenamiento jurídico otorga al legatario una serie de instrumentos para garantizar su derecho: anotación preventiva, su conversión en inscripción de hipoteca y la hipoteca en garantía de rentas o prestaciones periódicas del artículo 157 LH.

Article 880 of the Civil Code sets forth the legacy of periodic benefits as one of the legal possibilities available to the testator to be included in his will. It is a successive tract legacy by virtue of which the legatee acquires a right of credit, when being bequeathed a periodic pension or certain annual, monthly or weekly amount to a legatee, who may demand that of the first period, from the moment of the testator's death, and that of the following periods at the beginning of each one of them, without the pension or amount being returned if the legatee dies before the end of the current period. However, in the event of the possible non-compliance of the person to whom the legacy has been granted with his obligation to deliver the legacy, the legal system grants the legatee a series of instruments to guarantee his right: preventive annotation, its conversion into registration of mortgage and the mortgage in guarantee of rents or periodic benefits of Article 157 LH.
