Detenciones ilegales

Abstract

En el delito de detención ilegal se priva a un sujeto, ya sea por un particular o por una autoridad o funcionario público, de su libertad ambulatoria, la libertad más primaria que existe. Además, la libertad es uno de los derechos fundamentales protegidos por el ordenamiento jurídico español, concretamente en el artículo 17 de la Constitución Española. La libertad ambulatoria es la capacidad que tiene toda persona para poder establecer su situación en un espacio físico concreto, es un derecho inherente a cualquier persona. Las detenciones ilegales vienen recogidas en distintas partes del Código Penal, pero este Trabajo Fin de Grado se centrará en los delitos del Título VI “Delitos contra la libertad”, en su Capítulo I “De las detenciones ilegales y secuestros”, concretamente en los artículos 163 al 168.

In the crime of illegal detention, a subject is deprived, either by a private individual or by an authority or public oficial, of his freedom of movement, the most primary freedom that exists. Furthermore, freedom is one of the fundamental rights protected by the Spanish legal system, specifically in article 17 of the Spanish Constitution. Freedom of movement is the ability of every person to establish their situation in a specific physical space; it is a right inherent to any person. Illegal detentios are included in different parts of the Penal Code, but this Final Degree Project Will focus on the crimes os Title VI “Crimes against freedom”, in Chapter I “On illegal detentions and kidnappings”, specifically un the articles 163 to 168.
