Abstract

En el presente trabajo abordaremos la “compensación por trabajo doméstico” en el régimen de separación de bienes, un aspecto legal que ha ido ganando importancia a lo largo de los años. Hablaremos del artículo que la reconoce, el 1438C.c. y expondremos las condiciones que se deben reunir para acceder a ella. Esta consiste en un importe económico que uno de los cónyuges podría recibir del otro cuando se dieran los presupuestos necesarios, que busca compensar a la parte que se haya dedicado de forma exclusiva y excesiva en proporción a sus recursos, al trabajo en el hogar. El TS establece una serie de criterios para la concesión y cálculo de la compensación. En los últimos años se ha visto un incremento en la aplicación de ella, tratando de abordar de una manera más justa el divorcio de los cónyuges. También realizaré un estudio profundizado de la normativa vigente, la jurisprudencia actual y la doctrina sobre esta materia. Repasaremos la evolución del concepto en el tiempo, pero nos centraremos especialmente en la actualidad
