La desheredación de hijos y descendientes por maltrato psicológico

Abstract

El Trabajo de Fin de Máster presente tiene por objeto la realización de un dictamen jurídico sobre las diferentes cuestiones que se han planteado en un caso real de despacho. El asunto sometido a estudio pertenece al ámbito del Derecho de Sucesiones, pues el supuesto trata de la desheredación de hijos y descendientes por maltrato de obra e injuria grave de palabra y maltrato psicológico. La labor se centra principalmente en un análisis de las causas de desheredación alegadas por el testador en sus últimas voluntades, de las conductas imputadas a los sujetos desheredados y de los efectos de la desheredación sobre la herencia del causante y sobre los derechos de los legitimarios y descendientes. La cliente es una de las hijas del testador que no ha sido desheredada, por lo que este informe recoge, por un lado, una perspectiva global de la situación de la herencia frente a la desheredación del resto de herederos, y, por otro lado, aquellas líneas de defensa orientadas a la protección de derechos e intereses de aquella.

The present Master's Thesis aims to produce a legal opinion on the various issues raised in a current case from the law firm. The matter under study falls within the scope of Succession Law, as the case concerns the disinheritance of children and descendants due to physical abuse, serious verbal insult, and psychological mistreatment. The work primarily focuses on an analysis of the grounds for disinheritance claimed by the testator in their last will, the behaviors attributed to the disinherited individuals, and the effects of disinheritance on the estate of the deceased and on the rights of the legitimate heirs and descendants. The client is one of the testator's daughters who has not been disinherited, so this report provides, on one hand, a comprehensive perspective on the inheritance situation considering the disinheritance of the other heirs, and, on the other hand, outlines defense strategies aimed at protecting her rights and interests.
