El testamento de Isabel la Católica: un análisis jurídico

Abstract

En este trabajo se analiza el Testamento de Isabel la Católica desde una perspectiva jurídica e histórica, explorando su contenido, sus implicaciones y su relevancia en el contexto de su época. A lo largo del estudio, se examinan los principales problemas jurídicos que marcaron el reinado de Isabel y cómo estos se reflejan en sus últimas voluntades. Entre los temas clave destacan la regulación de la sucesión al trono, la gestión de las deudas y tributos de la Corona, la consolidación del poder real y la administración de justicia, así como la consideración de los pueblos indígenas americanos como súbditos libres de Castilla. Además, se lleva a cabo un análisis detallado de los aspectos formales y materiales del Testamento y del Codicilo, incluyendo su estructura, legalidad y ejecución. Se estudia también la aplicación del testamento tras la muerte de la reina, identificando en qué medida sus disposiciones fueron respetadas o modificadas por sus sucesores. A través de este enfoque, el trabajo busca demostrar la trascendencia jurídica y política del testamento de Isabel y su impacto en la historia de Castilla y de la Monarquía de España.

This paper analyzes the Testament of Isabella I of Castile from a legal and historical perspective, exploring its content, implications, and relevance within the context of its time. Throughout the study, the main legal issues that shaped Isabella's reign and how they are reflected in her final will are examined. Key topics include the regulation of the succession to the throne, the management of the Crown’s debts and tributes, the consolidation of royal power and the administration of justice, as well as the consideration of Indigenous American peoples as free subjects of Castile. Additionally, a detailed analysis of the formal and material aspects of the Testament and the Codicil is conducted, including their structure, legality, and execution. The study also examines the application of the testament after the queen’s death, identifying the extent to which its provisions were upheld or altered by her successors. Through this approach, the paper seeks to demonstrate the legal and political significance of Isabella's testament and its impact on the history of Castile and the Hispanic Monarchy.
