El conflicto de Gaza desde la perspectiva del Derecho Internacional

Abstract

En este trabajo se aborda el conflicto palestino-israelí y la situación de la Franja de Gaza desde una perspectiva de Derecho Internacional Público. Se analiza la evolución histórica del conflicto, destacando aspectos clave como el sionismo, la creación del Estado de Israel o enfrentamientos directos entre ambas partes del conflicto. Se profundiza también en cuestiones legales como el derecho a la legítima defensa, las violaciones del Derecho Internacional Humanitario, o el Derecho a la Autodeterminación de los pueblos. Además, se evalúa el papel de las instituciones internacionales como la Asamblea General de la ONU o el Consejo de Seguridad, el Tribunal Internacional de Justicia y la Corte Penal Internacional.

This paper addresses the Palestinian-Israeli conflict and the situation in the Gaza Strip from a Public International Law perspective. It analyses the historical evolution of the conflict, highlighting key aspects such as Sionismo, the creation of the State of Israel or direct confrontations between both parties to the conflict. It also delves into legal issues such as the right to self-defence, violations of International Humanitarian Law, or the right to self-determination of peoples. In addition, it assesses the role of international institutions such as the UN General Assembly or the Security Council, the International Court of Justice and the International Criminal Court.
