Abstract

Las redes sociales son cada vez más utilizadas para la interacción y comunicación, permitiendo compartir información personal públicamente y en privado. Sin embargo, esto conlleva riesgos significativos para los derechos de los menores, preocupando a nivel nacional e internacional. La publicación de datos personales en Internet puede vulnerar derechos como el honor, la intimidad y la propia imagen, siendo más graves cuando afectan a menores. Dada su falta de madurez y su gran uso de estas plataformas, es crucial garantizar una protección especial para su desarrollo personal y derechos fundamentales. Se requiere una protección reforzada donde el interés superior del menor prevalezca sobre otros derechos legítimos. Existen normativas y recomendaciones nacionales e internacionales que buscan proporcionar esta protección. Este trabajo analiza la regulación legal existente, los riesgos a los que se pueden enfrentar y las medidas para poder hacer frente y prevenir esos riesgos.

Social networks are increasingly used for interaction and communication, allowing personal information to be shared publicly and privately. However, this carries significant risks for children's rights, which are of national and international concern. The publication of personal data on the Internet can violate rights such as honour, privacy and self-image, being more serious when it affects minors. Given their lack of maturity and their extensive use of these platforms, it is crucial to guarantee special protection for their personal development and fundamental rights. Reinforced protection is required where the best interests of the child prevail over other legitimate rights. There are national and international regulations and recommendations that seek to provide this protection. This paper analyses the existing legal regulation, the risks they may face and the measures to address and prevent those risks.
