Análisis jurídico del Cuaderno Digital de Explotación Agrícola (CUE): Implicaciones normativas y desafíos para el sector agrario español

Abstract

El artículo examina el Cuaderno Digital de Explotación Agrícola (CUE) como una herramienta clave en la digitalización del sector agrario español, analizando su regulación mediante el Real Decreto 1054/2022 y su modificación por el Real Decreto 34/2025. Se abordan los aspectos jurídicos relacionados con la titularidad, el régimen que será de carácter voluntario salvo en supuestos sectoriales específicos (RD 34/2025), la responsabilidad legal del agricultor, y los retos de interoperabilidad y protección de datos. El estudio subraya las implicaciones de su implantación dentro de la PAC, destacando la necesidad de apoyo institucional y de medidas que garanticen una transición digital efectiva y equitativa en el medio rural.

The article examines the Digital Farm Register (CUE) as a key tool in the digitalization of Spain's agricultural sector, analyzing its regulation under Royal Decree 1054/2022 and its amendment by Royal Decree 34/2025. It addresses the legal issues related to ownership, the regime -which will be voluntary except in specific sectoral cases (RD 34/2025)-, the farmer's legal liability, and the challenges of interoperability and data protection. The study underscores the implications of its implementation within the Common Agricultural Policy (CAP), highlighting the need for institutional support and for measures that ensure and effective and equitable digital transition in rural areas.
