Los derechos de la víctima en la fase de ejecución penal

Abstract

En los últimos años, el papel de la víctima en el proceso penal ha sufrido un cambio notable, ha mostrado un protagonismo creciente que ha superado el tradicional enfoque centrado exclusivamente en el infractor. Normas como la Directiva 2012/29/UE y la Ley 4/2015, de 27 de abril, del Estatuto de la Víctima del Delito han contribuido a reforzar los derechos de las personas afectadas por delitos durante todo el procedimiento penal. Este trabajo se propone analizar el alcance de esos derechos, con especial atención a la fase de ejecución penal y al papel que desempeña el art 13 de dicha Ley. A lo largo del estudio se examinará la evolución normativa, las controversias doctrinales y los retos prácticos que plantea la efectiva participación de la víctima en esta etapa del procedimiento.

In recent years, the role of the victim in criminal proceedings has undergone a remarkable change, showing a growing prominence that has gone beyond the traditional offender-centred approach. Rules such as Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012 and Law 4/2015 of 27 April on the Crime Victims' Statute have contributed to strengthening the rights of persons affected by crime throughout criminal proceedings. This paper aims to analyse the scope of these rights, with a special focus on the criminal enforcement phase and the role played by art. 13 of this Law. Throughout the study, the normative evolution, the doctrinal controversies and the practical challenges posed by the effective participation of the victim in this stage of the procedure will be examined.
