Aportaciones de la criminología a la investigación policial: enfoque en el Cuerpo de la Guardia Civil

Abstract

La Criminología es una disciplina que, desde su creación en el siglo XIX, ha ido evolucionando y se ha ido definiendo de manera diferente por los expertos de esta materia en función de las corrientes dominantes en cada periodo histórico. El elemento común de la Criminología en toda su historia es que ha centrado su labor en el estudio del delito, la figura del delincuente, la víctima y las diferentes formas de control social para la lucha contra el delito. Sus metodologías han cambiado a lo largo de los años y se han modernizado hasta la actualidad centrado su papel en técnicas que ayudan en la investigación de hechos delictivos de gran complejidad. Las técnicas de perfilado del supuesto delincuente, la víctima y las formas de comisión del delito son un gran avance en el ámbito de la Criminología y sobre todo en el ámbito de la investigación. En relación con esto último, es decir, la investigación policial, tanto la Policía Nacional como la Guardia Civil, han sido los principales cuerpos policiales al servicio del ciudadano que han tenido que lidiar con la delincuencia que se ha dado en España en sus diferentes periodos históricos. Concretamente, la Guardia Civil, es una de las instituciones con más años de historia de nuestro país y, como es entendible, ha tenido que ir adaptando y modernizando sus métodos relativos a la prevención y a la investigación criminal para poder hacer frente a la realidad delictiva del momento. Por lo tanto, este Cuerpo ha visto que, ante la delincuencia actual, hay que implementar metodologías novedosas que puedan prestar ayuda en lo que la investigación de estos hechos se refiere, por lo que ha fomentado la creación de una estructura de Policía Judicial fuerte. Como punto de conexión, es entendible que la Criminología haya tenido su influencia en las tradicionales formas de investigación tanto de la Guardia Civil como de la Policía Nacional incluyendo técnicas novedosas de perfilado y de investigación que cuentan con apoyo científico suficiente como para que los miembros de las unidades de investigación de estos cuerpos los utilicen para facilitar el proceso de investigación. Influencia de ello es el desarrollo de 4 unidades específicas y metodologías concretas dentro de la Guardia Civil en las que cabe la figura del criminólogo pieza esencial para la averiguación del hecho delictivo.

Criminology is a discipline which, since its creation in the 19th century, has evolved and has been defined differently by experts in this field according to the dominant trends in each historical period. The common element of Criminology throughout its history is that it has focused its work on the study of crime, the figure of the offender, the victim and the different forms of social control in the fight against crime. Its methodologies have changed over the years and have been modernised to the present day, focusing its role on techniques that help in the investigation of highly complex criminal acts. The techniques of profiling the alleged offender, the victim and the ways in which the crime is committed are a great advance in the field of criminology and above all in the field of investigation. In relation to the latter, i.e. police investigation, both the Policia Nacional and the Guardia Civil have been the main police forces at the service of citizens who have had to deal with crime in Spain in its different historical periods. Specifically, the Guardia Civil is one of the institutions with the longest history in our country and, understandably, it has had to adapt and modernise its methods of prevention and criminal investigation in order to be able to deal with the criminal reality of the moment. Therefore, this Corps has seen that, in the face of current crime, it is necessary to implement novel methodologies that can help in the investigation of these facts and has therefore encouraged the creation of a strong Judicial Police stronger. As a point of connection, it is understandable that Criminology has had its influence on the traditional forms of investigation of both the Guardia Civil and the Policia Nacional, including novel profiling and investigation techniques that 5 have sufficient scientific support for the members of the investigation units of these bodies to use them to facilitate the investigation process. This has led to the development of specific units and methodologies within the Guardia Civil in which the figure of the criminologist is an essential part of the investigation of the criminal act.
