Las crisis matrimoniales

Abstract

Las crisis matrimoniales son el conjunto de situaciones en las que el matrimonio es ineficaz, rompiendo la convivencia que se le supone. Como crisis matrimonial consideramos nulidad, separación y divorcio, y en este orden se ha realizado, en este trabajo, un análisis de todas ellas desde una perspectiva jurídica en el Derecho Español, se estudian sus fundamentos legales, diferencias y efectos comunes. Se analizan cada una de ellas y se detallan los efectos comunes de las tres situaciones: medidas previas y provisionales, el convenio regulador, la guarda y custodia de hijos, el uso de la vivienda, el destino de animales domésticos, la pensión compensatoria, y la extinción del régimen económico. También se incluye un apartado dedicado a la mediación familiar como vía alternativa para resolver conflictos. El trabajo se apoya en legislación, doctrina y jurisprudencia relevante, mostrando una visión integral y práctica del tratamiento legal de las crisis matrimoniales en España.

Marital crises are the set of situations in which a marriage is ineffective, breaking down the supposed cohabitation. We consider marital crises to be annulment, separation, and divorce, and in this order, this work analyzes all of them from a legal perspective in Spanish law, studying their legal foundations, differences, and common effects. Each of them is analyzed and the common effects of the three situations are detailed: preliminary and provisional measures, the regulatory agreement, the custody of children, the use of the home, the fate of pets, alimony, and the termination of the property regime. A section is also included on family mediation as an alternative way to resolve conflicts. The work is based on relevant legislation, doctrine, and jurisprudence, providing a comprehensive and practical view of the legal treatment of marital crises in Spain.
