La desheredación

Abstract

El presente trabajo recoge un estudio pormenorizado acerca de la figura de la desheredación en nuestro ordenamiento jurídico, así como de las especialidades en los territorios forales. Un amplio estudio que determinara cuestiones como los principales requisitos y efectos de la figura, o así como sus diferencias con otras figuras afines que presentan cierta analogía con la figura jurídica de la desheredación. Para ello, se partirá de su evolución histórica cuyo origen deriva del Derecho romano, hasta la regulación actual vigente, para así conocer y analizar de forma detallada los elementos más importantes de la desheredación testamentaria. Se trata de analizar el impacto que esta figura tiene en nuestro Derecho de sucesiones. Por tanto, se va a hacer un amplio estudio bibliográfico de aquellos autores que han estudiado esta figura más a fondo.

The present work includes a detailed study regarding the figure of disinheritance in our legal system, as well as the specificities in the regional laws. A comprehensive study that will determine issues such as the main requirements and effects of this figure, as well as its differences with other similar figures that present some analogy with the legal figure of disinheritance. To do this, we will start from its historical evolution, whose origin derives from Roman Law, up to the current applicable regulations, in order to know and analyze in detail the most important elements of testamentary disinheritance. This involves analyzing the impact that this figure has on our inheritance law. Therefore, a thorough bibliographic study will be conducted of those authors who have studied this figure more in-depth.
